Actions Against the Dakota Access Pipeline Continue as Federal Court Rules to Allow Construction

A panel of federal judges on the U.S. Court of Appeals D.C. Circuit ruled to deny the Standing Rock Sioux Tribe’s request for an injunction to stop construction of the Dakota Access Pipeline (DAPL). Lawyers representing the tribe had argued that DAPL construction presented a threat to ancient sacred burial sites in the area, a condition which the federal appeals court contends has not been met.

The two page ruling seems to support Dakota Access, LLC resuming some construction activity in the areas within 20 miles of Lake Oahe (near the town of Cannon Ball, ND) while reiterating that the federal government still has jurisdiction over whether the pipeline construction under the Missouri River will be allowed to fully proceed…

Meanwhile, in Iowa, actions continued against the pipeline. Again from Unicorn Riot:

During two different direct actions on October 8th, water protectors blocked an access road leading to a Dakota Access Pipeline (DAPL) construction site where a horizontal directional drill is being used to bore under the Mississippi River.

Early in the afternoon, a crowd marched up the access road and sat in front of workers and law enforcement vehicles to block the road. Six people who had planned on being arrested in an act of civil disobedience were taken into custody.

Deputies from the Lee County Sheriff’s office also arrested several people from the crowd. They appeared to be randomly grabbing individuals and arresting them as they attempted to clear the access road.

We are aware of at least eight arrests but cannot confirm the final number at this time. Lee County Sheriff’s deputies and troopers from the Iowa State Patrol were observed using pain compliance techniques on people who had locked themselves together by their arms and sat down in the road.

After dispersing from the access road, the group moved to an area on the side of the road where they remained, cooking food and playing music.

Later that evening, around 7:30 p.m., a truck belonging to Michels corporation, a construction contractor building the Dakota Access Pipeline at this site and several others, was traveling down the same access road that the earlier arrests were on.

Several individuals ran in front of the truck, bringing it to a halt, allowing a woman named Jessica, a member of IWW GDC and the broader Black Lives Matter movement, to attach herself the bottom frame of the truck using a lock box device.

This latest action in Iowa comes hot on the heals of of lock-downs that took place several days before that led to even more arrests, including a Unicorn Riot journalist. See a report from UR here.

Today October 10, 2016, on the first day that the 20 mile buffer zone, injunction was lifted and giving illegal permission for the Dakota Access Pipeline to go ahead with construction was faced off by Indigenous Peoples and Water Protectors. Local, state and federal police agencies were deployed, while Indigenous Peoples stayed in prayer. 27 arrests were made today. #NoDAPL

Lockdowns continued on the ground:

In a show of sacrifice and great courage two of our Allies locked themselves to equipment to stop construction of the Dakota Access Pipeline. These are the statements from the Allies the reasons they made the choice to put themselves in harms way and be Water Warriors.#NODAPL

In an official statement from Red Warrior Camp, water protectors wrote on Columbus Day:

OFFICIAL STATEMENT FROM RED WARRIOR CAMP, OCTOBER 10TH, 2016 KKKOLUMBUS DAY OF ACTION EAGLE AND CONDOR UNITE AGAINST DAPL

At 6:30 a.m. a Sunrise Prayer Ceremony honoring the prophecy of the Eagle and the Condor uniting was attended by the people at the Standing Rock Encampment. The purpose of this prayer circle was to strengthen the will and hearts of all Native Peoples gathered at this frontline to pray for Mni Wiconi Sacred Water. A Peoples united will never be defeated, we will kill this Black Snake!

After the ceremony the Camp mobilized of well over 100 vehicles departed from the encampment to Dakota Access pipeline worksite 118. Upon arrival, the People began a powerful ceremony. The Morton County Sheriff’s departments insists that today action was not a protest but a riot. To a point we agree. This was not a protest. This was a ceremony in defense of Sacred Water. The gathering of Nations from Coast to Coast to Coast, the North to the South remained calm and orderly until dozens of Riot Police arrived intending to harm and arrest all present.

The Riot Police were armed and dangerous, yet we managed to diffuse them even though they were aggressively asserting they would and did arrest anyone and everyone who held the line, no one was rioting in any manner and everyone remained to hold them off for 4 hours. The 27 arrested Water Protectors are being charged with engaging in a riot, criminal trespass, and reckless endangerment, the footage and live streams from the work site today show the truth and reality of what happened.

The Governor of North Dakota is a shareholder in DAPL he is heavily invested in getting this pipeline built. The CEO, The Shareholders, and Investors in Dakota Access Pipeline, need to know stocks are plummeting and your monetary investment will be money lost.

POTUS Barak Obama has done nothing to uphold or honor the Fort Laramie Treaty of 1868. Instead jurisdiction of Treaty Lands is handed over to the U.S. Army Corp of Engineers, this is in direct violation of International Law. We the people at Oceti Sakowin are holding our line firm in our conviction that we not allow the pipeline to poison water that not only we rely on but 17 million people downstream rely on as well.

The State is using excessive force normally used in war overseas on unarmed Indigenous People to protect DAPL. This is tantamount to an act of war on the Indigenous People comparable to Palestine, the Government is waging on Native People and we call on all who can to come here and

Militarized sheriffs grabbed and arrested unarmed water protectors, even after their orders to disperse were followed. See how this person in a green hood was handled. Several arrests were made in this manner, and targeting specific warriors.

UPDATE: The 27 arrested at today’s Eagle & Condor action will bond out Tuesday morning. ‘Divergent’ actor Shailene Woodley, also arrested, is covering bail. However, the Red Warrior Camp needs ongoing donations for the legal fund.
