This communique comes from the Solidarity Group for the Freedom of Miguel Peralta as his final hearing approaches.

Miguel Peralta is an Indigenous Mazateco from the community of Eloxochitlán de Flores Magón in the Mexican state of Oaxaca. For years he participated as a member of the community assembly, the main collective decision-making body in his community.

In 2010, the Zepeda cacique family (local political bosses), using coercion, repression and imprisonment, facilitated the introduction of political parties into the community in order to take over government positions and reap the economic benefits of their power. This unleashed a very serious conflict in the community.

Since April 30^th, 2015, Miguel has been imprisoned, currently in the penitentiary of Cuicatlán, Oaxaca. Together with seven other prisoners and more than twenty more people being persecuted, they are accused of the death of one person during an attack carried out by the same Zepeda cacique family in December of 2014, while the community assembly was gathering to elect their traditional authorities.

On October 26^th, 2018, Miguel was sentenced to 50 years in prison on charges of homicide and attempted homicide, charges often fabricated against community organizers.

On September 12^th, 2019, Miguel Peralta Betanzos will be presented at the Mixed District Court of Huautla de Jiménez, Oaxaca, at 12pm for his final hearing. This takes place almost a year after his first “final hearing”, where the court denied Miguel’s right to be present, with the court clerk failing to file the necessary documents for Miguel to appear in court. Meanwhile, his community, his family and his comrades made noise out front of the court house demanding his presence, and more importantly, his freedom.

Following the pain and rage brought by Miguel’s 50-year sentence, we are still here. A recent decision made by the appellate judge stated that because Miguel wasn´t present at his final hearing, his 50-year sentence has been nullified, and his case needs to be returned to the point of his final hearing, at the court in Huautla de Jiménez, Oaxaca. This is the level of injustice we are facing.

We are realists in some sense, knowing this could well be just another tactic to further delay Miguel’s legal process, to further deprive him of his freedom. We know very clear who is behind all this: the Zepeda cacique family and the political apparatus represented in the State Congress of Oaxaca, flexing their political muscle to ensure certain decisions are made by the judges in their favor and against Miguel and his comrades.

We believe however that the time is approaching when the political charade put on by Elisa Zepeda Lagunas will collapse. It is reaching a point where it is too politically costly to defend the lies of Elisa Zepeda Lagunas and her family, where it is unsustainable for judges to keep Miguel locked up with decisions that are so utterly and clearly corrupt.

Within this context, we want to stress that the new judge at the mixed district court of Huautla de Jiménez, Oaxaca, is not the same who dictated the original 50-year sentence, and that he has the legal responsibility to properly study the file, and dictate a new verdict in Miguel’s case. This verdict won’t be made on the day of Miguel’s final court date but will be made in the weeks following. If the file is properly studied, and the court applies at the very minimum their own rules in the decision, Miguel will be freed.

We make a call to the comrades to be attentive to the happenings at Miguel’s final hearing on September 12th, and the verdict which will be released sometime afterwards. We invite those who feel some sort of solidarity with this committed struggle against the carceral state, to organize actions/events/statements in solidarity with Miguel Peralta demanding his immediate freedom, between now and his final hearing, on the day of his final hearing, and the time afterwards while we await a verdict.

Miguel Peralta es un compañero mazateco, oriundo de la comunidad de Eloxochitlán de Flores Magón, Oaxaca. Desde hace unos años acompaña a su pueblo como integrante de la Asamblea Comunitaria, principal órgano para la toma de decisiones colectivas.

Desde el año de 2010, el grupo caciquil encabezado por la familia Zepeda ha intentado de imponer, mediante la fuerza, la represión y la cárcel, a los partidos políticos, sus formas y métodos para ganar lugares en el gobierno e incrementar sus beneficios económicos, lo que desató un conflicto muy fuerte al interior de la comunidad.

Desde el 30 de abril de 2015, Miguel se encuentra preso en el penal de Cuicatlán, Oaxaca. Él junto a otras siete personas presas y más de una veintena de perseguidos, son acusados de la muerte de una persona durante un ataque perpetrado por el mismo grupo caciquil de los Zepeda en diciembre de 2014, mientras la Asamblea Comunitaria se encontraba reunida para elegir a una autoridad tradicional.

El 26 de octubre de 2018 Miguel fue condenado a 50 años de prisión bajo cargos de tentativa de homicidio calificado y homicidio calificado, cargos habitualmente fabricados contra luchadores sociales.

El próximo 12 de septiembre de 2019, Miguel será presentado en el Juzgado Mixto de Primera Instancia de Huautla de Jiménez, Oaxaca, a las 12 p.m. para una nueva audiencia final. Esto ocurre casi un año después de su primera “audiencia final”, en la que el Juzgado le negó el derecho a asistir, ya que el Secretario de Acuerdos, omitió realizar los documentos necesarios para que estuviera presente, presionado por una campaña de desprestigio contra Miguel orquestada por Elisa Zepeda, mientras su comunidad, su familia y sus compas hacíamos ruido frente al juzgado exigiendo su presencia y, lo que es más importante, su libertad.

Después del dolor y la rabia que trajo la sentencia de 50 años, aquí estamos de nuevo. Una reciente decisión dictada por un magistrado en el Tribunal Superior de Justicia del Estado de Oaxaca resolvió, sin entrar al fondo del estudio, que debido a que Miguel no estuvo presente en su audiencia final, la sentencia de 50 años se anula, y su proceso jurídico debe ser repuesto al punto de la audiencia final, en el Juzgado Mixto de Primera Instancia de Huautla de Jiménez, Oaxaca. Este es el nivel de injusticia al que nos enfrentamos.

Somos realistas respecto a que esta fue otra táctica para retrasar aún más el proceso legal de Miguel, para mantenerlo privado de su libertad. Sabemos muy bien quién está detrás de todo esto; la familia cacique de los Zepeda y el aparato de los partidos políticos representado en el Congreso de Oaxaca, exhibiendo su fuerza política para asegurar que los jueces tomen ciertas decisiones a su favor y en contra de Miguel y sus compas.

Creemos que se acerca el momento en que se derrumbará la farsa política puesta en marcha por Elisa Zepeda Lagunas. Ha llegado el punto en el que es demasiado costoso políticamente defender las mentiras de Elisa Zepeda y su familia, en donde será insostenible para el Poder Judicial mantener encerrado a Miguel con decisiones que son absoluta y claramente corruptas.

En este contexto, queremos enfatizar que el actual juez del Juzgado Mixto de Primera Instancia de Huautla de Jiménez, Oaxaca, no es el mismo que dictó la primera sentencia de 50 años, y que él tiene la responsabilidad legal de estudiar adecuadamente el expediente y dictar una nueva sentencia en el caso de Miguel. Esta nueva sentencia no se dictará el día de la audiencia final, sino en las semanas siguientes. Si el expediente se estudia correctamente y el juzgado aplica como mínimo sus propias reglas en la decisión, Miguel tendría que ser liberado.

Hacemos un llamado a lxs compañerxs para que estén atentxs a los acontecimientos de la audiencia final de Miguel el 12 de septiembre y a la sentencia que se dará a conocer algún tiempo después. Invitamos a quienes se sientan solidarixs con esta lucha comprometida contra el Estado carcelario, a organizar acciones/eventos/declaraciones en solidaridad y exigiendo la libertad inmediata de Miguel Peralta, desde ahora, el día de la audiencia final, y el tiempo posterior hasta que se dicte sentencia de libertad.
