Political Persecution Continues Against Miguel Peralta in Oaxaca

Statement from Indigenous Mazatec anarchist Miguel Peralta following the recent legal ruling in his case.

While the justice system continues acting as if it is independent and in defense of peoples’ rights, the expansion of cacique power continues at all costs, seeking to silence the voice of those who organize.

Recently we were notified of another legal decision in my case which adds to the ongoing legal charade and reaffirms the political interference being carried out by the current Secretary of Women in the state of Oaxaca, Elisa Zepeda Lagunas. From the use and abuse of her political position, she seeks to roll back the long legal process already traced by the prisoners and persecuted of Eloxochitlán de Flores Magón.

In August of 2022, my legal team Los Otros Abogadoz filed an appeal against my sentence demonstrating once again the repeated contradictions and fabrication of evidence in the legal file 02/2015. The recent legal decision was made without considering the merits of the case.

Furthering the simulation of justice, the magistrates decided to return my legal process to the presentation of evidence stage, with the supposed purpose of carrying out cross-examinations between me and the six witnesses, puppets of Elisa Zepeda and her father Manuel Zepeda Cortes.

What this means is a setback of at least seven years of my legal process, and the continued insistence on my imprisonment.

It is important to remember that one of the puppets of Elisa Zepeda admitted that in 2014 they did not give their testimony before the public prosecutor, but were only asked for their signature; another puppet refused to appear to testify; in order to get Manuel Zepeda and his brother to present themselves for testimony, it was necessary that the date was set on the same day that they had to go to the district court in Huautla de Jiménez in order to sign for another legal case in which they were being prosecuted; and finally, Elisa Zepeda and two of her other puppets managed to delay their testimonies for over a year.

Within this context, in addition to the power that Elisa Zepeda currently holds in the state government of Oaxaca, it is impossible to speak of a fair trial under equal conditions, when for nearly nine years since the socio-political conflict in Eloxochitlán de Flores Magón took place, the persecution, incarcerations, repression, and interference of power have only escalated.

Faced with this scenario of the fabrication of crimes in order to continue the political persecution seeking my return to prison, I call on everyone to strengthen the solidarity in the demand for the unconditional freedom of all the prisoners and persecuted of Eloxochitlán de Flores Magón, Oaxaca.

Let us ignite our fury until we are all free.

Carta de Miguel Peralta ante la sentencia del amparo interpuesto contra la condena de 50 años de prisión

Cuando la justicia sigue simulando que tiene independencia y atiende los principios de derechos, no es más que la continuidad de la expansión del poder caciquil, que a toda costa pretende mantener acallada la voz de quienes se organizan.

Recientemente nos notificaron de otro hecho que se suma a esas simulaciones jurídicas y que reafirma la intromisión política de la actual directora de la secretaria de la Mujer en Oaxaca, Elisa Zepeda Lagunas, que desde el uso y abuso de su cargo público, pretende retroceder el camino trazado de los presos y perseguidos de Eloxochitlán de Flores Magón.

El amparo promovido en agosto de 2022 por mi defensa, Los Otros Abogadoz, en el que se demostraba una vez más las reiteradas contradicciones y fabricación de pruebas dentro del expediente 02/2015 fue resuelto sin entrar al fondo de lo que se plantea.

Atendiendo a la simulación de la justicia, los magistrados decidieron regresar el proceso jurídico a la etapa de presentación de pruebas con la supuesta finalidad de realizar careos entre mi persona y los seis testigos aleccionados, marionetas de Elisa Zepeda y su padre Manuel Zepeda Cortes.

Esto conlleva a una regresión de por lo menos siete años del trayecto jurídico de mi proceso y a la insistencia de la privación de mi libertad.

No es menor recordar que una de esas marionetas reconoció que en 2014 no hizo su declaración ante el Ministerio Público porque se la llevaron a firmar; otra marioneta se amparó para no testificar en los interrogatorios; para lograr que Manuel Zepeda y su hermano se presentaran, se tuvo que recurrir a que se realizaran en la misma fecha en la que acudían al Juzgado de Huautla a firmar por otra causa penal en la que estaban siendo procesados; y finalmente Elisa Zepeda y las otras dos marionetas demoraron por más de un año para presentarse.

Con estos antecedentes, sumados al poder que actualmente ostenta Elisa Zepeda, es imposible hablar de un juicio justo en igualdad de condiciones, cuando por casi nueve años, desde el conflicto sociopolítico en Eloxochitlán de Flores Magón, la persecución, los encarcelamientos, la represión y la intromisión de poderes ha escalado.

Ante el escenario indolente de la fabricación de dos delitos que no cometí, la pretensión de mantener la persecución y devolverme a la prisión, les llamo nuevamente a fortalecer la solidaridad que han mostrado por la exigencia de una firme libertad de todos los presos y perseguidos de Eloxochitlán de Flores Magón, Oaxaca
